AI Influencers and AI Avatars in Advertising: Opportunities, Limits and Rules in Austria

27.10.2026 · 3 min read · by Sadettin Aksu

In short

An AI influencer is an artificially generated character that appears on social media and shows products; an AI avatar is a digital person that reads out a script. Both are fast and cheap, but trust comes mainly from real people. Realistic AI characters must often be labelled, and advertising must not deceive. For small businesses in Vienna, AI avatars are more useful for explainer videos than as a replacement for their own face.

What is an AI influencer, what is an AI avatar?

  • AI influencer: an invented person with their own profile whose images and videos are generated by AI. A team or brand is behind the profile.
  • AI avatar: a digital person that speaks a given script in videos, for example for training, explainers or product presentations.

What are the opportunities?

  • Availability: no shoot date, no travel costs, content in a short time
  • Multiple languages: the same video in German, English or Turkish
  • Explainer videos: recurring questions, instructions and training
  • Control: appearance and tone always stay the same

What are the limits?

  • Trust: people like to buy from people. Especially for local service providers such as medical practices, restaurants or trades, a real face usually works better.
  • Interchangeability: many AI characters look similar and are hard to remember.
  • Reactions: unlabelled AI people can be perceived as deception and trigger criticism.

Which rules apply in Austria?

  1. EU AI Act, Article 50: anyone publishing deepfakes, i.e. realistic AI images, videos or audio of people, places or events, must disclose that they are artificially generated. The RTR AI service centre provides information for Austria.
  2. UWG: advertising must not mislead. An AI character must not pose as a real customer or describe experiences that never happened.
  3. Platform rules: TikTok requires labelling of realistic AI content, Meta adds an "AI info" label to detected or disclosed AI content.
  4. Personality rights: real people may only be recreated with consent, including employees.
  5. Ad disclosure: paid content must be recognisable as advertising, just as with real influencers.

This is guidance, not legal advice. More in labelling AI advertising.

Frequently asked questions

Do I have to label an AI avatar?

If it looks like a real person, often yes, under the AI Act and platform rules. If in doubt, label it.

May an AI influencer promote my product?

Yes, if the product is shown correctly, no invented experiences are told and the advertising is recognisable as such.

Is an AI avatar cheaper than a video shoot?

For recurring explainer videos, often yes. For trust and loyalty, a short real shoot is usually the better investment.
